Typical Virginia Auto Policy Appraisal Clause Language
If we and you do not agree on the amount of loss, either may demand an appraisal of the loss. In such event, each party will select a competent appraiser. The two appraisers will select an umpire. If the appraisers cannot agree upon an umpire within a specified period of time, either party may request that the umpire be appointed by a judge of a court having jurisdiction.
Each appraiser will separately determine the actual cash value and amount of loss. If the appraisers fail to agree, they will submit their differences to the umpire. A written agreement signed by any two of the three will determine the amount of loss.
Each party will:
• Pay the expense of its chosen appraiser; and
• Bear equally the remaining expenses of the appraisal and umpire process.
