Typical Maryland Auto Policy Appraisal Clause Language

If we and you do not agree on the amount of loss, either may demand an appraisal of the loss. In that event, each party will choose a competent appraiser. The two appraisers will select an umpire. If they cannot agree upon an umpire within a specified time, either party may request that the umpire be selected by a judge of a court having jurisdiction.

Each appraiser will separately determine the actual cash value and amount of loss. If the appraisers do not agree, they will submit their differences to the umpire. A written decision agreed to by any two of the three will determine the amount of loss.

Each party will:
• Pay the expenses of its selected appraiser; and
• Share equally the expenses of the umpire and appraisal process.

Policy wording varies by insurance carrier and policy form. The language above reflects commonly used appraisal clause wording found in many Maryland automobile insurance policies.
