Typical New Jersey Auto Policy Appraisal Clause Language

If we and you do not agree on the amount of loss, either may demand an appraisal of the loss. In such event, each party will select a competent appraiser. The two appraisers will select an umpire. If they are unable to agree upon an umpire within a specified period of time, either party may request that the umpire be appointed by a judge of a court having jurisdiction.

The appraisers will separately determine the actual cash value and amount of loss. If they fail to agree, they will submit their differences to the umpire. A written decision agreed to by any two of the three will determine the amount of loss.

Each party will:
• Pay the expenses of its chosen appraiser; and
• Bear equally the remaining expenses of the appraisal and umpire process.

Policy wording varies by insurance carrier and policy form. The language above reflects commonly used appraisal clause wording found in many New Jersey automobile insurance policies.
